Terms of Service for Intuition IX

1. Acceptance of Terms

By accessing or using services from Intuition IX (ABN 25684784905) at intuitionix.com, you agree to comply with these Terms. If you do not agree, you must not use our services. Acceptance occurs via checkbox confirmation during checkout or account creation.


2. Governing Law

These Terms are governed by NSW laws and the Australian Consumer Law (ACL)

. You submit to the jurisdiction of NSW courts.


3. Services & Pricing

Services: Digital marketing tools, CRM access, and training. Details are within the pricing section in intuitionix.com

Pricing: All fees are in AUD and inclusive of GST. Prices may change, but existing subscriptions remain unaffected unless explicitly agreed.


4. Consumer Rights (ACL Compliance)

Statutory Guarantees: Our services come with guarantees under the ACL, including acceptable quality and fitness for purpose.

Remedies: For major failures, you are entitled to a refund, replacement, or compensation. Minor issues will be remedied within a reasonable time.


5. Subscriptions & Cancellations

Cooling-Off Period: 7 days for new subscriptions. Cancel via email to [email protected] for a full refund.

Ongoing Subscriptions: Cancel anytime. No refunds for partial periods, except as required by law.


6. Refund Policy

Refunds are granted only for major failures under the ACL.
No Refunds For: Change of mind, failure to use services, or misunderstandings about features.
Chargebacks: Disputed payments may result in account suspension and debt recovery action.


7. Liability

Exclusions: We exclude liability for incidental or consequential damages, except where caused by negligence or breach of ACL.

Cap: Liability is limited to fees paid in the 12 months preceding the claim.


8. Unlimited Accounts & Fair Use

Definition:"Unlimited" sub-accounts are subject to fair use. Excessive use (e.g., >500 sub-accounts, spam, or resource abuse) may incur fees or suspension.

Payment Requirements:Each sub-account must maintain a $25 AUD balance. Auto-top-ups apply below this threshold.


9. Dispute Resolution

Negotiation: Notify us in writing to resolve disputes.

Mediation: If unresolved, parties agree to mediate through the NSW Small Business Commissioner.

Tribunal/Court: Claims under $25,000 may be filed with NCAT.


10. Changes to Terms

We may update these Terms with 30 days’ notice. Continued use constitutes acceptance.

Material changes (e.g., pricing, refunds) allow you to terminate within 14 days for a pro-rata refund.


11. White Label & Branding

Permitted: Sub-account logo customization and internal branding.

Prohibited: Agency-level URLs, dashboard color changes, or masking Intuition IX’s platform branding.

13. Miscellaneous

Severability: Invalid clauses do not void the remaining Terms.

Entire Agreement: Supersedes prior agreements.

Definitions: “Unlimited,” “Fair Use,” and “Major Failure” align with ACL and NSW legal standards.


By using our services, you acknowledge understanding and compliance with these Terms and the ACL.
